These Terms & Conditions govern the purchase, sale, rental and use of products and services provided by Music Needs through its website, online platforms, social media channels, messaging platforms and physical collection arrangements.

By placing an order, making a payment, collecting a product, accepting delivery, or using any Music Needs service, you agree to these Terms & Conditions.


1. ABOUT MUSIC NEEDS

Music Needs is a South African music equipment retailer specialising in new and used music production, recording, podcasting, DJ, studio and related equipment.

Products may be:

  • Brand new
  • Used
  • Pre-owned
  • Refurbished
  • Ex-demo
  • Open-box
  • Clearance stock

The condition of each product will be stated on the relevant product listing where applicable.


2. PRODUCT INFORMATION

We make reasonable efforts to ensure that product descriptions, specifications, photographs, prices and availability are accurate.

However:

  • Product photographs may differ slightly from the actual product due to lighting, photography and screen settings.
  • Manufacturer specifications may change without notice.
  • Used products may show normal signs of previous use.
  • Minor cosmetic marks, scratches, scuffs or signs of wear may be present on used equipment.
  • Accessories included with used products will be stated in the product listing where reasonably possible.
  • Product packaging may not be original.
  • Products may be supplied with compatible replacement accessories where the original accessory is unavailable, where this is disclosed or reasonably apparent.

Customers are encouraged to ask questions about condition, accessories and functionality before purchasing where these details are important to their decision.


3. USED AND PRE-OWNED EQUIPMENT

Used equipment is sold according to the condition described in the relevant listing.

Unless specifically stated otherwise, normal cosmetic wear associated with previously owned equipment is not considered a defect.

Examples may include:

  • Minor scratches
  • Small marks
  • Fading
  • Signs of use
  • Minor cosmetic imperfections
  • Worn knobs or buttons where functionality is unaffected

Where a significant cosmetic defect or known functional issue is present, Music Needs will endeavour to disclose it in the product description.

Used equipment may have been tested before sale. Testing does not guarantee that equipment will remain free from wear or failure for the entire period of ownership.


4. PRICES

All prices displayed on the Music Needs website are in South African Rand (ZAR), unless otherwise stated.

Music Needs reserves the right to change prices at any time.

A price change will not affect an order that has already been accepted and paid for, subject to applicable law.

Errors in pricing or product information may occasionally occur. If an obvious pricing or listing error is identified before an order is fulfilled, Music Needs may contact the customer to correct the error or cancel the affected order and provide an appropriate refund where applicable.


5. PRODUCT AVAILABILITY

Products are subject to availability.

An item being displayed on the website does not necessarily guarantee that it remains available at the time an order is placed.

Used equipment is often available in limited quantities and may be sold on a first-confirmed-payment basis.

Music Needs may cancel an order where the product is no longer available, subject to applicable consumer law.


6. ORDERS

An order submitted through the website, WhatsApp, social media or another communication channel constitutes a request to purchase a product.

An order is only considered confirmed once Music Needs has accepted the order and, where applicable, payment has been successfully received.

Music Needs may contact customers to verify:

  • Product availability
  • Payment
  • Delivery information
  • Collection arrangements
  • Product specifications
  • Customer details

7. PAYMENT

Payment must be made using one of the payment methods made available by Music Needs.

Orders may only be processed once payment has been successfully confirmed, unless Music Needs has agreed to another arrangement in writing.

Music Needs does not consider a payment screenshot alone to constitute confirmation that funds have been received.

Where a payment is reversed, dishonoured, disputed or otherwise not successfully received, Music Needs may suspend fulfilment until the payment issue has been resolved.


8. DELIVERY

Delivery options and costs will be communicated during checkout or before the order is confirmed.

Delivery times are estimates and may be affected by:

  • Courier delays
  • Public holidays
  • Weather
  • Operational disruptions
  • Incorrect customer information
  • Address issues
  • Circumstances outside Music Needs’ reasonable control

Customers are responsible for providing accurate delivery information.

If incorrect or incomplete information causes additional delivery costs, the customer may be responsible for those additional costs where permitted by law.


9. DELIVERY INSPECTION

Customers should inspect products as soon as reasonably possible after receiving them.

If a product arrives visibly damaged, customers should:

  1. Photograph the packaging before opening it where possible.
  2. Photograph the product and any visible damage.
  3. Notify Music Needs as soon as reasonably possible.
  4. Retain the packaging until the matter has been resolved.

Customers should not dispose of packaging where it may be required for a courier investigation or return.


10. COLLECTION

Where collection is offered, the customer will be notified when the order is ready.

Customers should inspect the product at collection where reasonably possible.

Once collected, the customer is responsible for transporting the product safely.

Music Needs recommends using appropriate packaging and securing equipment properly during transportation.


11. RETURNS AND REFUNDS

Music Needs aims to provide customers with reliable products and a fair purchasing experience.

Returns and refunds will be handled in accordance with applicable South African consumer law, including the Consumer Protection Act where applicable.

Nothing in these Terms & Conditions is intended to remove, restrict or waive a consumer right that cannot lawfully be excluded.

Where a customer requests a return, Music Needs may require:

  • Proof of purchase
  • Order information
  • Photographs or videos showing the issue
  • The product and relevant accessories to be returned
  • An opportunity to inspect or test the product

12. RETURN CONDITION

Where a return is permitted, the product should be returned with all relevant components and accessories supplied with the original purchase.

A return may be refused or an appropriate remedy may be affected, to the extent permitted by law, where the product has been:

  • Physically damaged after delivery or collection
  • Modified or altered
  • Misused
  • Incorrectly installed
  • Incorrectly connected
  • Subjected to liquid damage
  • Subjected to electrical damage caused by incorrect power or voltage
  • Tampered with
  • Opened where opening the product caused or contributed to the fault
  • Damaged through negligence
  • Returned with missing components or accessories
  • Damaged through unauthorised repairs or modifications

These exclusions do not limit statutory consumer rights where the law provides otherwise.


13. CHANGE-OF-MIND RETURNS

A change-of-mind return is different from a product being defective.

Where a change-of-mind return is legally permitted or specifically offered by Music Needs, the product may need to be returned in an acceptable condition and within the applicable period.

Used, clearance, personalised, digital or specially ordered products may be subject to different return conditions where permitted by law.

Any voluntary Music Needs change-of-mind policy does not replace or limit statutory consumer rights.


14. DEFECTIVE PRODUCTS

If a product develops a fault, customers should contact Music Needs as soon as reasonably possible.

Music Needs may first perform an inspection or diagnostic test to determine the nature and cause of the problem.

Depending on the circumstances and applicable law, the appropriate remedy may include:

  • Repair
  • Replacement
  • Refund
  • Another legally applicable remedy

The specific remedy will depend on the nature of the defect, the applicable law, the age and condition of the product, and the circumstances of the claim.


15. MUSIC NEEDS 6-MONTH WARRANTY

Unless otherwise stated on the product listing, Music Needs may provide a 6-month limited warranty on eligible products.

The warranty period begins on the date of purchase.

The warranty is intended to cover defects or failures arising under normal intended use.

For used equipment, the warranty covers functional defects that were not disclosed at the time of sale, subject to the exclusions below.

The warranty does not cover normal wear and tear or damage caused by the customer.


16. WARRANTY EXCLUSIONS

The Music Needs warranty does not cover, to the extent permitted by law:

  • Accidental damage
  • Physical damage caused after purchase
  • Liquid or moisture damage
  • Incorrect voltage or power supply
  • Power surges where not attributable to a defect in the product
  • Lightning or electrical storms
  • Misuse or abuse
  • Negligence
  • Improper installation
  • Incorrect connection of equipment
  • Damage caused by incompatible equipment
  • Unauthorised repairs
  • Unauthorised modifications
  • Altered serial numbers or identifying markings
  • Missing components caused after purchase
  • Cosmetic damage that does not affect functionality
  • Normal wear and tear
  • Consumable items
  • Batteries where their reduced capacity is due to normal ageing
  • Cables or connectors damaged through misuse
  • Software issues unrelated to defective hardware
  • Damage caused by failure to follow manufacturer instructions

The warranty does not cover damage resulting from using equipment outside its intended purpose.


17. USED EQUIPMENT WARRANTY

Because used equipment has a history of previous use, customers acknowledge that some cosmetic wear and normal ageing may be present.

The Music Needs warranty is primarily intended to protect against qualifying functional defects and does not guarantee that used equipment will look or perform identically to brand-new equipment.

Specific exclusions or warranty periods may be stated on individual product listings.

Where a product is sold explicitly “as-is”, “for spares/repairs”, or with a clearly disclosed known fault, the listing will indicate this and the applicable legal rights will still apply.


18. WARRANTY CLAIM PROCESS

To submit a warranty claim, contact Music Needs with:

  • Customer name
  • Order number or proof of purchase
  • Product name/model
  • Description of the problem
  • Photos or videos where useful

Music Needs may request that the product be returned for testing.

Customers must not attempt unauthorised repairs before submitting a warranty claim where doing so could affect the assessment of the fault.

If a technician or service centre determines that the problem resulted from misuse, accidental damage or another excluded cause, the claim may not qualify for warranty coverage.


19. REPAIRS AND INSPECTIONS

Products returned for inspection may be tested by Music Needs or an appropriate technician/service centre.

Diagnostic procedures may include:

  • Functional testing
  • Electrical testing
  • Software testing
  • Audio testing
  • Connectivity testing
  • Visual inspection
  • Testing with compatible equipment

Customers may be asked to provide passwords, software licences or other information where reasonably necessary to test a product, but customers should not provide passwords that are unrelated to the product.


20. SOFTWARE, LICENCES AND DIGITAL PRODUCTS

Where products include software, plugins, licences, downloads or registration codes, availability may depend on the original manufacturer.

Music Needs cannot guarantee that a manufacturer’s discontinued software, registration system, online service or legacy activation system will remain available.

Where a software licence is transferable, Music Needs will provide the relevant information reasonably available to it.

Software compatibility is the customer’s responsibility unless otherwise stated.


21. PERSONAL DATA

Music Needs may collect and process customer information necessary to:

  • Process orders
  • Process payments
  • Deliver products
  • Provide customer support
  • Process returns and warranties
  • Communicate regarding orders
  • Meet legal and accounting requirements

Customer information will be handled in accordance with applicable South African privacy legislation and Music Needs’ privacy policy.


22. FRAUD AND SUSPICIOUS TRANSACTIONS

Music Needs reserves the right to delay, verify or cancel transactions where there are reasonable grounds to suspect:

  • Fraud
  • Payment fraud
  • Identity misuse
  • Stolen payment details
  • Unauthorised transactions
  • Abuse of promotional offers
  • Other unlawful activity

Where an order is cancelled for legitimate fraud-prevention reasons, any valid refund will be handled in accordance with applicable law.


23. PROMOTIONS AND DISCOUNTS

Promotions may have specific terms, expiry dates, stock limitations or eligibility requirements.

Unless explicitly stated otherwise:

  • Promotions cannot be exchanged for cash.
  • Discounts cannot be combined.
  • Promotional pricing applies only during the stated promotional period.
  • Promotional products remain subject to applicable return and warranty rights.

Music Needs reserves the right to correct obvious promotional errors.


24. PRODUCT RESERVATIONS

Where Music Needs agrees to reserve a product, the reservation period and any deposit requirements will be communicated to the customer.

Unless otherwise agreed in writing, Music Needs is not required to hold stock indefinitely without payment or a confirmed reservation arrangement.

Used products may remain available to other customers until the reservation is confirmed.


25. RENTAL EQUIPMENT

Where Music Needs offers equipment rentals, rental transactions are governed by the rental agreement applicable to that booking.

Rental customers may be required to provide:

  • Identification
  • Proof of address
  • Deposit
  • Security deposit
  • Payment
  • Other verification information

Rental equipment remains the property of Music Needs unless otherwise agreed.

The customer is responsible for the equipment while it is in their possession.


26. RENTAL DAMAGE

Rental customers may be responsible for damage, loss, theft or misuse occurring while equipment is in their possession, subject to the applicable rental agreement and any insurance or damage-waiver arrangement.

Customers must return equipment in substantially the same condition in which it was supplied, allowing for normal reasonable use.


27. SECURITY DEPOSITS

Where a security deposit is required, it may be used to cover eligible amounts including:

  • Damage
  • Missing equipment
  • Missing accessories
  • Loss
  • Theft
  • Excessive cleaning
  • Late returns
  • Other charges agreed to in the rental agreement

Any remaining refundable balance will be processed in accordance with the applicable rental agreement.


28. CUSTOMER RESPONSIBILITY FOR EQUIPMENT

Customers are responsible for using equipment according to its intended purpose and manufacturer instructions.

Customers should use appropriate:

  • Power supplies
  • Cables
  • Adapters
  • Stands
  • Cases
  • Ventilation
  • Protection
  • Electrical equipment

Music Needs is not responsible for damage caused by the customer’s use of incompatible equipment or accessories.


29. THIRD-PARTY PRODUCTS

Some products may be manufactured by third parties.

Manufacturer warranties, software licences and support policies may apply in addition to any warranty provided directly by Music Needs.

Where appropriate, customers may be directed to the manufacturer or authorised service centre.


30. THIRD-PARTY SERVICES

Music Needs may use third-party providers for:

  • Payments
  • Courier services
  • Hosting
  • Email
  • Website services
  • Software
  • Communications
  • Advertising

Music Needs is not responsible for interruptions caused solely by third-party services outside its reasonable control.


31. INTELLECTUAL PROPERTY

All Music Needs branding, logos, website content, photographs, graphics, written content and original materials remain the property of Music Needs or their respective owners unless otherwise stated.

Customers may not reproduce, copy, modify or commercially distribute Music Needs content without permission.


32. WEBSITE CONTENT

Music Needs attempts to maintain accurate website information but does not guarantee that every page will always be free from errors, omissions or outdated information.

Music Needs may update:

  • Product information
  • Prices
  • Images
  • Specifications
  • Stock information
  • Website features
  • Terms and policies

without prior notice, subject to applicable law.


33. LIMITATION OF LIABILITY

To the maximum extent permitted by South African law, Music Needs will not be liable for indirect, incidental or consequential losses arising from the use or inability to use a product or service.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by law.

Nothing in these Terms & Conditions limits statutory consumer rights.


34. FORCE MAJEURE

Music Needs will not be responsible for delays or failures caused by circumstances beyond its reasonable control, including:

  • Natural disasters
  • Fire
  • Flood
  • Power outages
  • Internet failures
  • Courier disruptions
  • Strikes
  • Civil unrest
  • Government restrictions
  • Supplier disruptions
  • Cyber incidents
  • Other events outside reasonable control

Music Needs will make reasonable efforts to resume affected services when possible.


35. CUSTOMER REVIEWS

Customers may be invited to submit reviews, photographs or other feedback.

By submitting content, customers confirm that they have the right to provide that content.

Music Needs may use genuine customer reviews for marketing purposes, subject to applicable law and reasonable privacy considerations.


36. DISPUTES AND COMPLAINTS

Music Needs encourages customers to contact us directly first so that complaints can be resolved as efficiently as possible.

Customers should provide:

  • Order number
  • Product details
  • Description of the complaint
  • Relevant photographs or documentation

Music Needs will make reasonable efforts to investigate and resolve legitimate complaints.

Nothing in this section prevents a consumer from exercising any statutory rights or pursuing remedies available under South African law.


37. GOVERNING LAW

These Terms & Conditions are governed by the laws of the Republic of South Africa.

Where applicable, the Consumer Protection Act 68 of 2008, Electronic Communications and Transactions Act 25 of 2002, Protection of Personal Information Act 4 of 2013, and other applicable South African legislation will apply.

Where these Terms & Conditions conflict with a mandatory provision of South African law, the applicable law will prevail.


38. CHANGES TO THESE TERMS

Music Needs may update these Terms & Conditions from time to time.

The latest version published on the Music Needs website will apply to future transactions.

Changes will not retrospectively remove rights that have already accrued to customers under applicable law.
